Allahabad HC Sends RO/ARO Reservation Case to Single Judge

The Lucknow bench of the Allahabad High Court on Tuesday remitted the matter relating to the reservation dispute in the RO/ARO recruitment examination-2023 to a single judge bench for adjudication on merits. The court also directed that the interim stay on fresh appointments to the posts would continue.

Division Bench Order

The order was passed by a division bench comprising Justice Rajan Roy and Justice Manjive Shukla while disposing of a special appeal filed by Vivek Yadav and others. The appeal challenged the February 1, 2026 order of a single judge bench that had refused interim relief to the appellants in their writ petition.

Arguments of the Appellants

It was argued on behalf of the appellants that they belonged to the OBC category and had secured marks in the preliminary examination higher than at least 25 candidates selected for the mains examination under the general category. Despite this, the appellants were declared unsuccessful in the preliminary examination.

Response from State and Commission

Opposing the plea, the state government and the Uttar Pradesh Public Service Commission informed the court that most of the successful candidates under the recruitment process had already been appointed.

Court's Observation

The court observed that since the writ petition was originally pending before the single judge bench, the matter ought to be decided by the same bench on merits.
