Prayagraj: Taking serious note of non-compliance with a court order, the Allahabad High Court has directed the Varanasi Police Commissioner to appear on June 11 with a detailed explanation for the failure to conclude an inquiry against an employee despite the court's directive.
Background of the Case
Justice Prakash Padia was hearing a contempt petition filed by Param Hans Gupta, an employee in the Varanasi police department who had been placed under suspension. The petition alleged that despite the court's order dated September 17, 2025, which directed the completion of a departmental inquiry within a stipulated timeframe or reinstatement of the employee, neither action was taken.
The counsel for the petitioner argued that the judgment of September 17 had been fully complied with by the petitioner, but for reasons unknown to the opposite party, the disciplinary proceedings were not concluded within the prescribed time, nor was the suspension order dated November 10, 2024, revoked.
Wider Pattern of Non-Compliance
It was further contended that in a large number of cases, similar orders passed by the court had not been complied with by the authorities in Varanasi and other districts. Taking serious note of this pattern, Justice Padia, in his order dated June 9, directed the Registrar (Compliance) to communicate a copy of the order to Varanasi Police Commissioner Mohit Agarwal through the Chief Judicial Magistrate (CJM), Varanasi, by Wednesday.
The court has summoned the police commissioner to appear in person on June 11 to provide a detailed explanation for the non-completion of the inquiry and the failure to reinstate the employee.
