Andhra Pradesh High Court Denies Interim Relief to Actor Mohan Babu in Student Union Kidnapping Case
The Andhra Pradesh High Court, in a significant ruling on Tuesday, declined to grant interim relief to prominent actor and chancellor of Mohan Babu University, Manchu Mohan Babu. Background of the Case and Police Action
Following a formal complaint lodged by Reddy Kumar, the Tiruchanuru police registered a case on February 3 against Mohan Babu, his son Manchu Vishnu, and several other individuals. In response, Mohan Babu approached the high court seeking interim protection from arrest and requesting the quashing of the case. His legal team argued vehemently that he had no connection whatsoever to the alleged offense.
Arguments Presented by Mohan Babu's Defense
Representing Mohan Babu, advocate N Ashwani Kumar presented a detailed defense before the court. He asserted that the petitioner was not present in Tirupati on the day the incident allegedly occurred. According to Kumar, Mohan Babu traveled from Hyderabad to Tirupati only after learning about the event, with boarding passes submitted as evidence to support this claim.
Ashwani Kumar further contended that Mohan Babu is actively investigating the identities of those responsible for the kidnapping of the student union leaders. He alleged that the case was filed with the malicious intent of tarnishing the reputation of Mohan Babu University, suggesting ulterior motives behind the accusations.
Prosecution's Counterarguments and Evidence
On behalf of the police, assistant public prosecutor Sandeep presented a compelling counterargument. He stated that prima facie evidence indicates Mohan Babu's involvement in the alleged crime. Sandeep revealed that investigations showed Mohan Babu was in telephonic contact with the university's Public Relations Officer, and police identified an exchange of messages related to the incident.
The case stems from allegations regarding the collection of exorbitant fees at the university and the prevention of students who could not pay the career development fee from taking examinations. When student union leaders attempted to submit a representation to the district collector regarding these issues, they were reportedly intercepted and kidnapped.
Sandeep elaborated that police acted swiftly, locating the student union leaders in a forest area. Injuries were observed on their noses and mouths, adding gravity to the allegations. Despite a notice issued to Manchu Vishnu under BNSS section 179, he failed to appear before the police, leading Sandeep to plead against granting any interim protection to Mohan Babu.
Victim's Representation and Court's Directive
Advocate Nalluri Madhava Rao, representing the victim Reddy Kumar, argued that Mohan Babu attempted to suppress voices questioning injustice through brute force. As Rao requested additional time to submit further arguments, Justice Venkata Jyothirmayee Pratapa scheduled the next hearing for February 12. The court directed the police to provide all pertinent details related to the case, ensuring a comprehensive review before any interim decisions are made.
