Bhopal Court Orders FIR Over Dead Man's Bail Bond in Irani Dera Gang Case
Bhopal: Dead Man Used in Fake Bail Bond for Irani Dera Gang

Bhopal Court Uncovers Shocking Fraud: Deceased Man's Identity Used in Bail Bond Scam

In a bizarre and audacious legal fraud, a judicial magistrate's first class (JMFC) court in Bhopal has ordered the police to file a First Information Report (FIR) against a group of individuals, including lawyers, notaries, and fake witnesses. The case revolves around the use of a dead man's photograph to secure bail for members of the notorious Irani Dera gang, who were arrested for serious crimes including rioting and obstructing police duties during a raid in the city.

Details of the Fraudulent Bail Bond Scheme

Bhopal police have registered a case under IPC sections 420 (cheating) and 467 (forgery of valuable security) against six persons. The accused include two lawyers, an oath commissioner, and two individuals who furnished bail bonds in court for the gang. The gang was rounded up from Irani Dera on December 27-28 for targeting police personnel. Shockingly, one of the persons who provided the bail bond was deceased at the time, while the other had no legitimate claim over the land pledged as guarantee in the bond.

The FIR was registered at Nishatpura police station on the directive of JMFC Laxmi Waskale. Deputy Commissioner of Police Mayor Khandelwal confirmed that the court had ordered a police inquiry into the matter. The accused are also facing charges under multiple sections of the Bharatiya Nyaya Sanhita (BNS) for obstructing police from discharging their duty.

How the Scam Unfolded and Legal Proceedings

After the bail was granted, the son of the deceased man came forward, revealing that his father had passed away. This revelation prompted the prosecution to move the sessions court, seeking cancellation of the bail. In response, the JMFC court ordered the registration of an FIR against the six individuals involved in the fraudulent activity.

However, the public prosecutor clarified that only the bail bonds were cancelled, not the bail itself, as they were found to be fabricated. This distinction highlights the complexity of the case, where the legal system is grappling with forged documents while ensuring justice is served.

Key Points of the Case:

  • The Irani Dera gang was arrested for rioting and obstructing police during a raid.
  • A dead man's photo was used in bail bonds to secure release for gang members.
  • Six persons, including legal professionals, are accused of fraud and fabrication.
  • The court has ordered an FIR and police inquiry under IPC and BNS sections.
  • Only the bail bonds were cancelled due to being fake, raising questions about bail validity.

This incident underscores the challenges in the judicial system, where fraudulent practices can undermine legal processes. Authorities are now investigating the extent of this scam and its implications for future cases in Bhopal.
