The Bombay High Court on Monday directed the Brihanmumbai Municipal Corporation (BMC) and other civic bodies to submit comprehensive data on potholes and manholes across the city, and inform the court about the steps taken to address these hazards. The directive was issued by a division bench comprising Justices Ajey Gadkari and Kamal Khata while hearing a suo motu Public Interest Litigation (PIL) initiated in 2013 concerning pothole-related accidents.
Background of the PIL
The PIL was taken up by the court on its own motion after several deaths and injuries were reported due to potholes. In October 2025, the High Court had fixed compensation amounts for victims: Rs 6 lakh for fatalities and between Rs 50,000 and Rs 2.5 lakh for injuries, depending on severity.
Advocate Highlights Recent Incidents
Advocate Ruju Thakker, appearing for the petitioners, informed the court that despite the compensation order, several incidents have occurred recently. She emphasized that with the monsoon approaching, it is crucial for civic bodies to provide data on the number of uncovered manholes and potholes, especially on major roads.
Thakker earlier flagged 19 deaths on Ghodbunder Road, a key arterial route in the Thane region. However, the Thane Municipal Corporation's advocate argued that not all deaths on that road are due to potholes; many result from rash and negligent driving. Thakker countered, stating, “Ghodbunder Road is riddled with potholes, and residents are protesting.”
Court’s Stern Observation
Justice Khata expressed displeasure over the lack of proactive measures, remarking, “Don’t push the people to come on the streets.” The court questioned why civic bodies have not taken sufficient steps to repair roads and secure manholes. The bench underscored the need for immediate action to prevent accidents during the rainy season.
Next Hearing Scheduled
The High Court will hear the matter next on June 24. Civic bodies have been directed to submit detailed reports on the current status of potholes and manholes, along with the actions taken to mitigate risks.
