Bombay High Court Upholds Charges Against Mahendra Salgaonkar in Prostitution Case
The Bombay High Court has affirmed a lower court's decision to proceed with framing charges against Mahendra Salgaonkar under the Immoral Traffic Prevention Act. This ruling stems from a 2014 FIR that accused Salgaonkar and three others of operating a massage parlour in Mapusa, allegedly employing girls for prostitution activities.
Background of the Case
In 2014, authorities registered an FIR after a decoy customer was sent to the spa in question. Investigations revealed that the establishment was not registered and lacked necessary licences from the directorate of health services and the pollution control board. The police alleged that the parlour was a front for illicit activities, specifically prostitution.
Legal Arguments and Court Observations
Salgaonkar's defence argued that statements from the girls involved did not indicate exploitation or procurement for prostitution, and there was no concrete evidence of such activities. However, the court noted that the victims' statements were largely stereotypical, describing female masseurs providing massages to male clients.
When compared with the complainant's and decoy customer's accounts, the court found prima facie material suggesting that one victim accepted extra payment for a massage and agreed to provide special services. This led the court to conclude there was sufficient evidence to frame charges against Salgaonkar.
Implications of the Ruling
This decision reinforces the legal framework against human trafficking and immoral practices under the Immoral Traffic Prevention Act. It highlights the judiciary's role in scrutinising evidence and ensuring accountability in cases involving alleged exploitation. The case will now proceed to trial, where further details and testimonies will be examined.
The ruling serves as a reminder of the ongoing efforts to combat illegal activities in the guise of legitimate businesses, emphasising the importance of proper licensing and regulatory compliance in the wellness and spa industry.
