Calcutta HC: Vodafone Must Get IPRS Nod for Caller Tunes, Not Just Saregama
Calcutta HC: Vodafone Needs IPRS Nod for Caller Tunes

The Calcutta High Court on May 8 delivered a significant ruling in the ongoing copyright dispute over caller tunes and ringtones. The court held that Vodafone cannot offer songs as caller tunes or ringtones solely under agreements with sound recording companies. Instead, the telecom giant must also obtain permission from the Indian Performing Right Society Ltd (IPRS), the organization that represents authors, composers, and publishers of musical works.

Background of the Case

The case revolved around Vodafone's value-added service that used film and non-film songs as caller tunes and ringtones. Vodafone had argued that its agreement with Saregama, a manufacturer, seller, and publisher of sound recordings, was sufficient to license the songs for such commercial use. However, the IPRS opposed this stance, asserting that authors of the underlying literary and musical works in a sound recording are entitled to royalties and other consideration when those recordings are commercially exploited.

Court's Decision

A division bench comprising Justices Debangsu Basak and Md Shabbar Rashidi ruled in favor of the IPRS. The court held that Saregama had no legal authority to license the underlying musical and literary works embedded in sound recordings for Vodafone's commercial use. The bench emphasized that Vodafone requires express permission from the IPRS to use songs as caller tunes or ringtones. The court also noted that the Copyright Amendment Act of 2012 permits the IPRS to claim such royalties.

This ruling has significant implications for the telecom and music industries. It reinforces the rights of authors and composers, ensuring they receive fair compensation when their works are used in commercial services like caller tunes. The decision clarifies that agreements with sound recording companies alone are insufficient for the commercial exploitation of underlying musical and literary works.

In addition to the legal implications, the court's decision highlights the importance of adhering to copyright laws in the digital age. As value-added services become increasingly popular, companies must ensure they have the necessary permissions from all relevant rights holders.
