Judicial Magistrate First Class (JMFC) Vijitashva Pushkar, acting on a complaint filed by Yuvraj Singh Bundela, ordered the Kotwali police in Datia to register an FIR against then SHO Arvind Bhadouria, head constable Pushpraj Jauharia, constable Kapil Sharma, and woman constable Pooja Sikarwar under relevant sections of the Indian Penal Code. The court also mandated a fair and impartial investigation, with the final report to be submitted without undue delay.

Incident Description

According to the complaint, on March 27, 2024, the police personnel entered Bundela's rented residence in Datia without a search warrant or written authorization. They allegedly assaulted Bundela and his family members, including his mother who was struck with a lathi, and confiscated their mobile phones. Bundela claimed he was beaten and later implicated in a false case.

Legal Observations

In its order, the court observed that the allegations of forcibly entering a private residence without lawful authority and assaulting women and a minor child could not be considered acts performed in the discharge of official duty. Therefore, prior prosecution sanction was not required in this case. The matter has been listed for receipt of the FIR copy on June 16.
