Ahmedabad Court Issues Interim Injunction in Trademark Dispute Over Astrology Services

A city civil court in Ahmedabad has issued a temporary restraining order against Vishal Ladsaria, prohibiting him from using the trademark or trade name "Bejan Daruwalla" for astrology-related services. This decision comes in response to a trademark rights dispute filed by Pandit Holdings, which alleges infringement of its intellectual property.

Background of the Trademark Conflict

The legal battle began when Ladsaria applied to register the trademark "Chirag Bejan Daruwalla" for astrology services. Pandit Holdings, claiming prior ownership and use of the registered trademarks "Bejan Daruwalla" and "Nastur Daruwalla," filed a lawsuit seeking an interim injunction. The company asserted that these marks are used for a wide range of services, including astrology consultations, gemstones, yantras, rudraksha, puja services, and publications.

Pandit Holdings detailed that its rights originated from agreements executed in 2003 and 2006 with the late astrologer Bejan Daruwalla. These rights were later formally assigned to the company through a deed dated December 8, 2020. The company argued that the trademarks have built substantial goodwill over years of continuous use across various platforms, such as websites, mobile applications, and print media.

Arguments from Both Parties

In court, Pandit Holdings emphasized its established reputation and the potential for consumer confusion if Ladsaria were allowed to use a similar mark. On the other hand, Ladsaria opposed the injunction, alleging that Pandit Holdings suppressed facts, lacked true ownership, and acted with mala fide intent. He further claimed that his brother, Chirag Ladsaria, had been adopted by the Daruwalla family and is now known as Chirag Nastur Bejan Daruwalla, justifying the use of the disputed mark for services provided by him.

Court's Ruling and Rationale

After hearing arguments from both sides, Chamber Judge PN Navin ruled in favor of Pandit Holdings. The court found that the company had established a prima facie case and that the balance of convenience tilted in its favor. Judge Navin observed that even if Chirag Ladsaria had been adopted by the Daruwalla family, this did not automatically grant the defendant the right to use the registered trademark "Bejan Daruwalla" for business activities in the same class of services.

The court stated: "The present Notice of Motion application succeeds and an interim injunction is granted against the defendant. The defendant is restrained from using the trade name 'CHIRAG BEJAN DARUWALLA,' which is deceptively similar to the trademark of the plaintiff, until the final disposal of the suit." This ruling underscores the importance of protecting registered trademarks from potential infringement, especially in industries like astrology where brand identity and trust are crucial.

The case highlights ongoing tensions in the astrology services market, where trademarks can significantly impact business operations and consumer perception.
