Kushinagar Fast-Track Court Delivers Death Sentence in Child Assault and Murder Case
A fast-track court in Kushinagar district has delivered a landmark judgment, sentencing a 22-year-old man to death by hanging for the horrific sexual assault and murder of a seven-year-old boy. The verdict was pronounced by Special Judge Dinesh Kumar under the Pocso Act, marking a swift conclusion to a case that shocked the community.
Swift Justice in a Heart-Wrenching Case
The judgment was delivered within an impressive 30 working days from the registration of the FIR on February 23, with the chargesheet filed on March 7. The court convicted the accused, identified as Pintu alias Koyal, under multiple sections of the Bharatiya Nyaya Sanhita (BNS) and the Pocso Act.
The court specifically found him guilty under Section 103(1) for murder and Section 238A for causing disappearance of evidence. In addition to the death penalty, the court imposed a substantial fine of Rs 4 lakh, directing that this amount be paid to the victim's mother as compensation for rehabilitation purposes.
Chilling Details of the Crime Emerge
According to police investigations, the tragic incident unfolded on the evening of February 22 when the young victim attended a tilak ceremony in his village but never returned home. A missing report was filed the following morning, and within hours, local residents discovered the boy's body near his residence.
Kushinagar SP Keshav Kumar, who closely monitored the investigation, revealed that the postmortem examination confirmed death by asphyxiation and established sexual assault. "The breakthrough in the case came when we discovered that the victim's relative, Pintu, had been missing since the night of the incident," Kumar explained.
Forensic Evidence Seals the Conviction
A search of the accused's residence led to the recovery of blood-stained shorts, which family members confirmed he had worn on the night of the crime. Police also contacted the accused's wife, who had been living at her parental home for several months, and her statements further strengthened suspicion against him.
Investigators emphasized that forensic evidence played a crucial role in securing the fast conviction. The blood-stained shorts and a used condom recovered near the body were sent for forensic analysis. The DNA report, expedited within seven days upon request to the Forensic Science Laboratory (FSL), conclusively matched the accused with samples found on the victim.
SP Kumar highlighted the thoroughness of the investigation: "All evidence was collected promptly and scientifically, ensuring a watertight case. The DNA findings were incorporated into the chargesheet, significantly strengthening the prosecution's position."
Confession and Legal Proceedings
Police revealed that during interrogation, the accused confessed to luring the child to a secluded location with money, sexually assaulting him, and then killing him to avoid identification. He subsequently hid the body before fleeing the scene.
The accused was arrested and sent to jail on February 25. The trial records have now been forwarded to the high court for confirmation of the death sentence. Until the high court's decision, the convict will remain lodged in Deoria district jail.
This case represents one of the fastest convictions in such a serious crime under the Pocso Act, demonstrating the effectiveness of coordinated investigation and forensic science in delivering justice for the most vulnerable victims.
