Delhi Court Denies Bail to Contractors in Janakpuri Biker Death Case

A Delhi court on Wednesday denied bail to contractors Himanshu Gupta and Kavish Gupta in connection with the Janakpuri biker death case, taking note of the seriousness of the incident and the current stage of the investigation. The court also vacated the interim protection from arrest that had been granted to the duo on February 10.

Court Proceedings and Legal Arguments

Additional Sessions Judge Harleen Kaur was hearing the bail applications moved by the Gupta duo, who had previously been granted interim protection from arrest. The court had earlier directed that no coercive steps be taken against them until February 18 and recorded their undertaking to join the investigation as required from February 11.

During the hearing, counsel for the applicants submitted that the two contractors were executing work allotted through a government contract and were "simply doing their job," with no deliberate hand in the said incident. However, opposing the pleas, the respondent's counsel argued that "a family had lost their son due to the alleged lack of due diligence on the part of the accused," and therefore, they should not be granted bail easily.

Parallel Case Involving Subcontractor

In a parallel development, a magistrate court also dismissed the bail plea of subcontractor Rajesh Prajapati, who had been charged with withholding information about the accident. This decision underscores the legal scrutiny surrounding the case, which has drawn public attention due to its tragic nature and implications for contractor accountability.

The court's denial of bail reflects a cautious approach, emphasizing the need for a thorough investigation into the circumstances leading to the biker's death. The incident has raised questions about safety protocols and due diligence in government-contracted work, with authorities continuing to probe the matter.
