Delhi High Court Directs MCD to Clear Unauthorised Vendors from Nehru Place
In a significant ruling, the Delhi High Court has mandated the Municipal Corporation of Delhi (MCD) to take immediate and decisive action against unauthorised vendors operating within the Nehru Place commercial complex area. The court's order, issued on Monday, stems from pressing safety and security concerns that have arisen due to the presence of these vendors in the bustling commercial hub.
Safety Concerns Prompt Judicial Intervention
A bench comprising Justices Prathiba M Singh and Madhu Jain underscored that allowing hawkers to vend in Nehru Place has escalated security risks for the entire commercial complex. The bench explicitly noted, "It is clear that permitting hawkers to vend in Nehru Place area has raised security concerns for the entire commercial complex itself." This observation highlights the court's prioritisation of public safety in its decision-making process.
The court further referenced previous directives from the Supreme Court, which had called for the relocation of a limited number of authorised vendors or the creation of earmarked areas for them. However, the current situation involves unauthorised vendors, exacerbating the safety issues.
Dismissal of Vendors' Plea and Imposition of Costs
The High Court dismissed a plea filed by two vendors who sought to prevent the MCD or police from evicting them from their vending sites opposite the Mansarovar Building at Nehru Place. In its order, the court expressed bewilderment, stating, "It is inexplicable as to how the petitioners are being permitted to vend in Nehru Place area." As a consequence, the court imposed a cost of Rs 10,000 on the petitioners, reinforcing the seriousness of their unauthorised activities.
Emphasising the urgency of the matter, the bench ordered the MCD to "take immediate action and ensure that no unauthorised vendors are allowed to vend in the Nehru Place area." This directive leaves no room for ambiguity, compelling the municipal authorities to enforce compliance promptly.
Nehru Place Designated as a No-Vending Zone
The court also took judicial notice of the fact that Nehru Place has been officially declared a no-vending and no-hawking zone. This designation is not new; it follows a series of orders issued by the High Court in 2021, which were prompted by a fire incident in the area. These past orders aimed to enhance safety measures, and the current ruling reinforces those efforts by addressing the persistent issue of unauthorised vending.
The court's reference to the 2021 orders underscores a continuous judicial effort to maintain order and safety in Nehru Place, a critical commercial centre in Delhi. By linking the current directive to previous safety concerns, the bench has highlighted the ongoing nature of the problem and the need for sustained enforcement.
