The Delhi High Court has issued a significant directive to civic authorities, mandating a thorough check on the adherence to sanctioned building plans and fire safety regulations by commercial establishments in the popular Majnu ka Tila area. The court's order came on Wednesday while disposing of a public interest litigation (PIL) that highlighted serious safety hazards.

Court's Directive to DDA and Special Task Force

A bench comprising Chief Justice D K Upadhyaya and Justice Tushar Rao Gedela allowed the Delhi Development Authority (DDA) and the Special Task Force (STF) to treat the PIL as a formal complaint. The authorities have been instructed to take necessary action against outlets, including cafes, bars, and restaurants, that are operating without approved building plans and adequate fire safety measures.

The court specifically directed that the decision and subsequent action be taken promptly, preferably within a period of three months. This timeline sets a clear deadline for the enforcement drive. The bench noted that the DDA had already registered a suo motu complaint on the matter and asked the authorities to review the petitioner's grievances and take appropriate legal action.

Safety Hazards in the Tibetan Hub

The PIL had raised alarming concerns about the structural integrity and operational safety of numerous multi-storey buildings in Majnu ka Tila, a neighborhood situated on the banks of the Yamuna River and renowned for its Tibetan culture and cuisine. The plea claimed that several structures have been illegally built up to 7-8 floors, with unauthorized basements, rooftops, and recreational facilities.

It argued that these conditions create an immediate and life-threatening hazard for visitors and residents. The petition drew a parallel to the recent tragic nightclub fire in Goa, presenting it as a stark warning of the potential disaster that could occur in similar circumstances of negligence.

Judicial Empathy Amidst Enforcement

While ordering strict compliance with the law, the bench also made a poignant oral observation, acknowledging the socio-economic context of the area. "Just ensure they are in order, half the students in Delhi University go there. Most of these are run by Tibetans, they are just surviving. Govt hasn't done much for them, for the past 40-50 years, they are surviving there," the court remarked.

This statement highlights the court's awareness that the commercial establishments in Majnu ka Tila are not just businesses but a means of livelihood for a community. The order, therefore, balances the imperative of public safety with a recognition of the need for supportive governance.

The original plea had sought directions to the Municipal Corporation of Delhi (MCD) and the Delhi Fire Services (DFS) to enforce the National Building Code and fire safety measures stringently. With the High Court's order, the DDA and STF are now empowered to lead a coordinated effort to audit and regulate the area, aiming to prevent accidents and ensure the safety of the thousands of students and patrons who frequent this iconic Delhi spot.
