Delhi High Court Dismisses Criminal Case Against Ice Cream Vendor After Amicable Settlement
In a significant ruling, the Delhi High Court has quashed criminal proceedings against an ice cream vendor who was accused of voyeurism and stalking. The decision came after the complainant agreed to a settlement and expressed her desire to move forward with her life, leading the court to conclude that continuing the case would serve no purpose.
Court Observes Resolution and Appreciates Benevolent Gesture
The court, in its recent order, noted that the dispute had been voluntarily resolved between the parties. The complainant supported the plea for quashing the FIR, which was registered in 2018, stating she wished to put the matter behind her. Additionally, the court highlighted a benevolent gesture by the accused, who offered to distribute ice cream to all personnel at Model Town police station within a week, after coordinating with the investigating officer.
"Since the petitioner is an ice cream vendor, as a benevolent gesture, he wishes to distribute ice cream to the entire staff of PS Model Town. This court appreciates the gesture," the order stated, underscoring the positive step taken by the vendor.
Background of the Case and Changed Circumstances
The FIR had been filed under multiple sections of the Indian Penal Code, including:
- Section 354(C) for voyeurism
- Section 354(D) for stalking
- Section 385 for putting a person in fear of injury to commit extortion
- Section 384 for extortion
However, the court emphasized that circumstances had evolved significantly since the registration of the FIR. "Much water has flowed since the registration of the FIR. The respondent is now married and has been blessed with a child, and she wishes to move ahead in her new and stable life," the court recorded, acknowledging the complainant's current life situation.
Settlement Details and Court's Decision
As part of the settlement reached in January, the complainant was paid Rs 45,000, which was informed to the court. Taking an overall view of the facts and the compromise, the court allowed the plea and quashed the proceedings, effectively ending the legal battle. This ruling highlights the judiciary's role in facilitating resolutions where parties mutually agree to settle, especially in cases involving personal disputes.
