On October 25, 2022, the Daba police registered a case against Dharamjit Mishra, Anuj Kumar, Amit Kumar, Vishal, and Sagarpal under sections 302 (murder) and 34 (common intention) of the Indian Penal Code for the killing of Jham Kumar. The incident unfolded when Sub-Inspector Amrinder Singh, while on patrol duty, received information from the control room about a dead body discovered in a vacant plot at Maha Maya Nagar under the jurisdiction of Daba police station in Ludhiana.

Upon arriving at the scene, police found Din Dyal Chaudhary, the father of the deceased, and Bheem Chaudhary, the brother, present. Din Dyal Chaudhary, who worked as a laborer, provided a late-recorded statement detailing the events. He explained that his youngest son, Jham Kumar, was unemployed and often stayed at home, occasionally consuming alcohol with friends and returning late.

Eyewitness Account and Motive Revealed

According to the prosecution, on October 24, 2022, at around 9:15 AM, Din Dyal returned home and inquired about Jham Kumar, only to learn from his wife that he had left with friends at approximately 8:30 PM the previous evening. Later, at about 2:05 AM, Din Dyal was awakened by screams. He rushed to the roof of his house and witnessed five individuals brutally assaulting his son in the vacant plot behind their residence.

When Din Dyal and his son Bheem Chaudhary approached the plot, they saw the accused—Dharamjit, Anuj, Amit, Kala, and Sagar Pal—hurling bricks at Jham Kumar. Upon spotting the complainant and his brother, the assailants fled, leaving Jham Kumar dead on the ground. During the trial, Bheem Chaudhary testified that when he and his father pleaded with the attackers to spare Jham Kumar, they retorted that he had squandered money earned by them in gambling, revealing the motive behind the murder.

Court's Verdict and Legal Reasoning

Police swiftly arrested the accused and filed a chargesheet, leading to a trial where the defendants claimed false implication. However, the court, after meticulously evaluating the evidence, found their arguments unconvincing.
