The Allahabad High Court has ordered the Uttar Pradesh government to pay Rs 25,000 as compensation to a Prayagraj resident for unlawful detention, emphasizing that detaining a person in police custody beyond 24 hours without producing him before a magistrate is illegal.
Court's Observations on Police Accountability
A division bench comprising Justice JJ Munir and Justice Sanjay Kumar passed the order while hearing a petition filed by Matamber Mishra, who was allegedly illegally detained by police officer Surya Prakash Dubey. Mishra was kept in police custody from November 26, 2022, to November 27, 2022, without being produced before a magistrate.
The bench noted that judicial declarations and government policies often have limited impact on officers implementing them. The court observed that officials tend to rely on the belief that out of one thousand violations, only one citizen would step forward to enforce rights and seek accountability, allowing many violations to go unchecked.
When a citizen approaches the court, it becomes the court's duty to enforce rights already guaranteed under the Constitution, laws, and government policy, the bench said. The judgment also noted that even in the counter affidavit filed by the police, there was no denial of the allegation of illegal detention, which the court treated as significant while granting relief.
Recovery of Compensation from Erring Officer
The bench further granted liberty to the state to recover the amount from the erring officer in whatever manner they deem appropriate, including deducting it from his remuneration. This directive underscores the court's commitment to holding individual officers accountable for violations of citizens' fundamental rights.
Constitutional Safeguard Under Article 22
Article 22 of the Constitution mandates that an arrested person must be produced before a magistrate within 24 hours, excluding travel time. Detention beyond that period requires judicial remand. This provision forms a crucial safeguard against arbitrary arrest and prolonged custody without oversight.
The case highlights the importance of police accountability and the role of the judiciary in enforcing constitutional guarantees. The compensation awarded serves as a reminder that unlawful detention will not be tolerated, and authorities must adhere to legal procedures.
