Bombay High Court Mandates Security Overhaul at Kolhapur District Court Complex
The Bombay High Court's Kolhapur bench has issued a directive to the Kolhapur superintendent of police, ordering a joint meeting with key stakeholders to finalize steps for strengthening security at the Kolhapur district court complex. This move comes in response to a detailed report submitted by a 10-member lawyers' committee, which was established by the High Court after an assault on a lawyer by a litigant on March 7.
Committee Report Exposes Critical Security Gaps
The committee, comprising advocates practicing in the Kolhapur district court, submitted its findings on March 26, revealing significant deficiencies in the current security setup. The panel highlighted that the court complex experiences a daily footfall of approximately 2,000 visitors, alongside 800 to 1,200 lawyers and 400 court staffers. Given this substantial turnout, the existing security measures were deemed inadequate to ensure safety and order.
In the aftermath of the March 7 incident, superintendent of police Yogeshkumar Gupta has already implemented some enhancements under various High Court directions. These include increasing police personnel from 42 to 60, introducing additional rounds of police patrolling teams, and implementing QR code scanning visits across four floors to register entries. However, the committee's report emphasized that these measures are insufficient, pointing out the absence of door-frame metal detectors, despite police having hand-held versions.
High Court's Directive for Immediate Action
In an order passed by the bench of justices Madhav J Jamdar and Pravin S Patil last Thursday, the court stated that further strengthening of security is imperative. The order noted, "Perusal of the report submitted by the committee of advocates practicing in Kolhapur district court, appointed by this court, shows that it is still further necessary to strengthen the security arrangement at the Kolhapur district court complex." Government pleader Ms. Neha Bhide assured the court that immediate steps would be taken, including the installation of door-frame metal detectors, to bolster security.
The High Court has directed the superintendent of police to convene a joint meeting with the superintending executive engineer of the Public Works Department (PWD), the Kolhapur district court registrar, and three representatives from the Kolhapur advocates association. This collaborative effort aims to finalize and implement comprehensive security upgrades to prevent future incidents and ensure a safer environment for all court users.
Related SC/ST Case Against Bar Association Members
In a related development, the Kolhapur police have filed a case under the SC/ST (Prevention of Atrocities) Act against 15 members of the Kolhapur Bar Association. This action stems from a complaint by the alleged attacker in the March 7 assault, who is a housewife involved in a divorce petition initiated by her husband. According to the lawyer representing the husband, the woman attacked the lawyer, leading to her booking. Subsequently, the woman accused lawyers present of hurling caste-based abuses and physically assaulting her, causing injuries.
Following her complaint to the High Court, which directed police action, a case was registered against 15 individuals, including the woman lawyer representing the husband, the president of the Kolhapur District Bar Association (a petitioner in the case), and other lawyers. The charges include sections 115(2) for voluntary causing hurt, 189(2) for unlawful assembly, 191(2) for rioting, and 190 for common object under the BNS Act 2023, along with the SC/ST Act. Deputy superintendent of police Priya Patil is leading the investigation, with no arrests made so far.
This case underscores the broader tensions and legal complexities surrounding the incident, highlighting the need for robust security and ethical conduct within the court premises. The High Court's proactive measures aim to address these issues comprehensively, ensuring justice and safety for all parties involved.
