HHRC Takes Up Case of Ill Resident Denied Parking in Gurugram

The Haryana Human Rights Commission (HHRC) has stepped in to address a serious complaint of alleged inhuman treatment and discrimination against a critically ill resident by the management of a residential society in Gurugram. The commission took suo motu cognisance of the matter on Monday.

Patient Denied Basic Facility Despite Critical Condition

The case involves complainant Jai Prakash, a resident of GLS Avenue in Sector 92, Gurugram. Prakash is suffering from end-stage renal disease, a life-threatening condition where both his kidneys are completely damaged. He is dependent on dialysis treatment three times a week, which severely impacts his mobility. The complaint states he has difficulty walking and has even fainted on several occasions.

Despite his grave medical condition, the staff of his residential society allegedly denied him permission to park his vehicle inside the society premises. This denial came even though temporary permission had been granted earlier. The complainant argued that this basic facility was crucial for him due to his health challenges.

Allegations of Harassment and Selective Favoritism

In the complaint presented before HHRC member (judicial) Kuldip Jain, Prakash detailed further grievances. He resides with his wife, who works as a private school teacher and is the family's sole earning member, and their two minor daughters aged 11 and 3.

He alleged that the society staff ignored his serious health status and subjected his family to mental harassment and discrimination. The complaint also claimed that parking facilities were selectively provided only to residents who were either known to the staff or who paid illegal gratification, while he was deliberately targeted.

Commission's Strong Observations and Directives

After reviewing the complaint, Member Kuldip Jain issued a strong order. He observed that it prima facie appeared the complainant, suffering from a serious and life-threatening condition, was subjected to mental harassment, discrimination, and inhuman treatment by the builder or society staff.

The order stated that the deliberate denial of a basic and reasonable facility like parking, despite full knowledge of his deteriorating health, caused the victim unnecessary physical hardship, mental agony, and humiliation.

Most significantly, Jain clarified that such conduct amounts to a violation of the right to life with dignity guaranteed under Article 21 of the Constitution of India. The alleged acts were noted to reflect insensitivity and to have created an unsafe, hostile, and degrading environment for Prakash's wife and minor children.

The commission has directed the local administration to appear and submit a complete reply at the next hearing. Furthermore, it has instructed the Commissioner of Gurugram Police to ensure the safety and security of the complainant and his family from any coercive measures by the society management.

The HHRC concluded that the facts disclosed a clear prima facie case of human rights violation, warranting its immediate intervention to deliver justice.
