Ahmedabad: The renowned restaurant chain Honest Reveira has taken legal action against a Goa-based meat delivery company, Honesty Foods, alleging that the similarity in their names and labels is causing confusion among its pure vegetarian customers. The chain claims that customers are mistakenly believing that Honest has opened a new branch in the coastal state serving non-vegetarian food. The court has issued a notice to Honesty Foods, with the next hearing scheduled for June 8.
Background of the Dispute
Honest Reveira, which has been operating since 1976, argues that its customer base primarily consists of Hindus and Jains who patronize the chain for its high-quality vegetarian offerings. The association of the Honest name with non-vegetarian products, the chain contends, could harm its goodwill and reputation, leading to a loss of customer trust. Honesty Foods is engaged in the business of raw and frozen meat, including beef, pork, and vegetables.
Legal Claims
The Ahmedabad-based restaurant chain has filed a suit in the local commercial court, seeking to restrain Honesty Foods from using the 'Honesty' brand. Honest Reveira alleges infringement of its trademark rights, noting that it has been using the trademark and label since 1976 and holds registrations under multiple classes of the Trade Marks Act, 1999. The chain also claims copyright registration for its label artwork, which features an oval device and a red-and-yellow color scheme. It asserts extensive domestic and overseas presence through franchises and licensed users.
Allegations of Deceptive Similarity
Honest Reveira accuses Honesty Foods, which has addresses in North Goa, Pune, and other locations, of using a name and label that are "deceptively similar" to the Honest mark. The key allegation, however, centers on reputational harm. Honest's counsel, Zahid Shaikh, submitted that the chain has received numerous queries from customers asking whether it has begun dealing in non-vegetarian food. Customers are reportedly confused about whether Honest has opened a new branch for non-veg offerings.
Customer Sentiments and Religious Concerns
The suit petition states: "The plaintiffs state that they are exclusively engaged in the preparation and sale of purely vegetarian food. Their customer base predominantly comprises members of the Hindu and Jain communities, who patronise the Plaintiffs solely for their reputation of serving high-quality vegetarian food. The association of the plaintiffs' name with non-vegetarian products sold by the defendant has caused serious dissatisfaction and emotional distress among such customers, including hurt to their religious sentiments. This confusion not only misleads the public at large but also causes irreparable harm to the goodwill and reputation of the plaintiffs, resulting in loss of trust and diversion of customers away from the plaintiffs' business."
Court's Response
Honest Reveira has demanded that Honesty Foods be stopped from using the name and that its listings be removed from online platforms. Judge H G Pandya of the city civil court noted: "The plaintiff's device mark is having a dominant feature of word 'Honest' whereas the defendant is running a business with the trademark name 'Honesty Foods'. It is trite to note that honesty word is pertaining to quality, value and is attached to morality. Considering both device marks, this court is of the view that before passing any ad-interim injunction, the defendant is also required to be heard."
