High Court Orders Reconsideration of Land Acquisition
The Karnataka High Court has directed the Karnataka Industrial Areas Development Board (KIADB) to reconsider the additional land acquisition for a pellets plant in Sandur. The court found that the acquisition proceedings were vitiated due to non-compliance with mandatory requirements regarding the consent of landowners.
Landowners' Grievances
The landowners contended that the KIADB failed to obtain their consent as required under the law. They argued that the acquisition process was flawed and violated their rights. The court, after hearing the petitioners, observed that the mandatory provisions had not been followed, necessitating a fresh look at the matter.
Court's Directive
Justice M. Nagaprasanna, presiding over the case, ordered the KIADB to reconsider the acquisition afresh, ensuring compliance with all legal requirements. The court emphasized that the consent of landowners is a crucial element in land acquisition for industrial purposes and cannot be bypassed.
Impact on the Pellets Plant Project
The decision is likely to delay the expansion of the pellets plant in Sandur, which is a key industrial project in the region. The KIADB has been directed to complete the reconsideration process within three months. The plant, operated by a major mining company, is expected to boost local employment and economic activity, but the court's order underscores the importance of adhering to legal procedures.
