Kolhapur High Court Establishes Committee to Address Court Complex Security Concerns

The Bombay High Court's Kolhapur bench has taken a decisive step to address security and safety issues at the district court complex in Kasba Bawda, Kolhapur. In response to a recent incident, the court has constituted a committee comprising ten lawyers from the Kolhapur District Bar Association. This move aims to thoroughly study and recommend improvements for the protection of legal professionals and visitors within the premises.

Background: Assault Incident Triggers Legal Action

The formation of this committee follows a disturbing event on March 7, when a lawyer was assaulted outside a courtroom in the district court complex. The victim, who was representing a client in a divorce case, was attacked by a woman involved in the same legal matter. This incident not only sparked protests among lawyers but also led to the filing of a Public Interest Litigation (PIL) before the High Court. The PIL sought directives to the state government to implement measures ensuring the safety and security of lawyers practicing in the complex.

Committee Composition and Mandate

The High Court bench, consisting of Justice Madhav Jamdar and Justice Pravin Patil, announced the committee's formation on Thursday. The bar association proposed the names of ten advocates to serve on this panel: Sampatrao Pawar, D N Pathade, R L Chavan, Ahijeet Kapse, Santosh Shah, Kalpana Mane, Harsha Khandelwal, Sarvesh Bhandigare, Raju Otari, and Atul Jadhav. These members are all practicing lawyers in the district court, bringing firsthand experience to the table.

The committee's primary task is to assess the current security infrastructure and propose upgrades. They have been requested to submit their comprehensive report by March 26. Their suggestions are expected to cover various aspects of security enhancements, potentially including technological and personnel-based solutions.

Proposed Security Measures and Government Response

In addition to the committee's work, the Advocates' Association of Western India Kolhapur has already put forward several recommendations to bolster security. These include:

  • Increased patrolling within the court premises
  • Rotational deployment of police personnel to ensure consistent vigilance
  • Establishment of a permanent police chowki (outpost) inside the court complex

The court has directed Kolhapur Superintendent of Police Yogeshkumar Gupta to consider these suggestions seriously. During the proceedings, the government pleader assured the court that appropriate steps would be taken to upgrade the Closed-Circuit Television (CCTV) system in the District Court Complex. This commitment indicates a proactive approach to integrating technology with traditional security measures.

Implications and Future Steps

This initiative underscores the judiciary's commitment to creating a safe environment for legal practitioners. The assault incident highlighted vulnerabilities that could hinder the administration of justice. By involving local lawyers in the security review process, the High Court ensures that recommendations are practical and tailored to the specific needs of the Kolhapur court complex.

The committee's findings will likely influence broader policy changes, potentially serving as a model for other district courts facing similar challenges. As the March 26 deadline approaches, stakeholders await actionable insights that could transform security protocols, reinforcing the rule of law and protecting those who uphold it.
