Kolkata HC hears pleas against KMC demolition notices

More than 10 petitions affecting over 150 persons from Topsia and Kasba have been filed before the vacation bench of the Calcutta High Court, challenging demolition notices served by the Kolkata Municipal Corporation (KMC). The matters are scheduled to be heard on Friday.

Petitions Mentioned Before Vacation Bench

Two counsels on Tuesday mentioned the petitions before Justice Partha Sarathi Sen, who granted leave to file the pleas. The cases will be heard by another vacation bench comprising Justice Shampa Dutt (Paul) on Friday.

Details of Petitions

Five petitions, mentioned by advocate Firdous Shamim, involve premises in Topsia and Kasba. Another lawyer, Md Zafaryab Jilani, mentioned eight to nine petitions. Some petitions concern an apartment in Topsia, which has 13 blocks with approximately 20 to 30 flats per block. It was alleged that a Section 400(1) notice was pasted on a wall instead of being served individually to flat owners.

One petitioner from G J Khan Road in Topsia moved the High Court, stating that the KMC issued a notice under Section 400(1) of the KMC Act in the names of two other persons. He has not yet mutated his name as the flat was recently purchased. His plea argues that as the lawful owner, the notice should be issued in his name to provide him with an opportunity of hearing.

The court has yet to issue any interim order, and the matter will be taken up on Friday for further proceedings.
