Kurukshetra Court Delivers Justice in Minor Rape Case

In Kurukshetra, a fast-track court has handed down a strong verdict in a disturbing case of sexual assault against a minor girl. The additional district and sessions judge, presiding over the Fast Track Special Court for Rape and POCSO Act Cases, convicted Aman, a resident of Thanesar. The court sentenced him to a total of fourteen years of rigorous imprisonment. It also imposed a substantial fine of Rs 1.85 lakh for his crimes of abduction and rape.

Case Details and Police Action

The case began with a complaint filed at the District Women Police Station on August 29, 2022. A woman from Pipli reported that her school-going daughter, a minor, had been persistently followed by a boy. According to the complaint, on August 28, 2022, the accused lured the girl away under false pretenses. He then forcibly raped her.

After returning home, the traumatized girl disclosed the horrific incident to her mother. This prompted the immediate filing of the police complaint. Law enforcement acted swiftly, registering the case under multiple sections of the Indian Penal Code and the Protection of Children from Sexual Offences Act.

Sub-inspector Taro Devi led the investigation. The police arrested the accused, Aman, and the court remanded him to judicial custody. Investigators compiled the evidence and filed a chargesheet in court, setting the stage for the trial.

Court Proceedings and Witness Testimonies

The trial proceeded in the Fast Track Special Court with regular hearings. The prosecution presented witness testimonies and concrete evidence to build its case. After evaluating all the material, the judge found the evidence compelling and conclusive.

On January 19, 2026, the court pronounced Aman guilty of all charges. The judge emphasized the severe nature of offenses committed against a minor child. The ruling aimed to deliver justice that reflected the gravity of the crime and adhered to legal provisions designed to protect children.

Breakdown of the Sentence and Fines

The court delivered a detailed sentencing order, specifying punishment for each offense. The breakdown of the rigorous imprisonment and fines is as follows:

  • IPC Section 363 (Kidnapping): 5 years of rigorous imprisonment with a fine of Rs 10,000. Failure to pay adds one more month in jail.
  • IPC Section 366 (Kidnapping to compel marriage): 7 years of rigorous imprisonment and a Rs 20,000 fine. Default on payment brings an additional one-month imprisonment.
  • IPC Section 506 (Criminal intimidation): 1 year of rigorous imprisonment plus a Rs 5,000 fine. Non-payment results in fifteen extra days in prison.
  • POCSO Act Section 4 (Penetrative sexual assault on a child): 14 years of rigorous imprisonment and a Rs 1,00,000 fine. Defaulting on this fine means six more months behind bars.
  • POCSO Act Section 12 (Sexual harassment of a child): 3 years of rigorous imprisonment with a Rs 50,000 fine. Not paying adds one month to the sentence.

The court directed that the sentences will run concurrently. This means the total period of imprisonment amounts to fourteen years. The cumulative fine totals Rs 1.85 lakh. The judgment includes clear provisions for additional imprisonment if the convicted person fails to pay the imposed fines.

This verdict sends a clear message about the consequences of such heinous acts against minors. It underscores the judiciary's commitment to applying the POCSO Act stringently to ensure child safety and deliver timely justice.
