Litigant Ejected from Supreme Court for Abusive Outburst
In an unprecedented incident at the Supreme Court of India on Friday, a litigant appearing in person was forcibly removed from Court No. 13 after he allegedly hurled abuses and threw his case file during a hearing. The incident occurred before a Bench comprising Justice KV Viswanathan and Justice Alok Aradhe, who were hearing a petition challenging an Allahabad High Court order.
Confrontational Behavior from the Start
The litigant, identified as Prabal Pratap, appeared in a black coat and was confrontational from the beginning of the hearing. According to reports, Pratap addressed the Bench in an unusual manner, stating, “Mr judicial servant, I order you to order the registration of an FIR against the ACP Lucknow.” Justice Viswanathan, visibly surprised, retorted, “You are ordering me? You are ordering us?”
Outburst and Removal
Pratap then declared, “That is all from my side. Everything is on record,” before allegedly hurling abuses and throwing his case papers into the air. Security personnel immediately overpowered him and removed him from the courtroom. The court proceedings continued normally after his removal.
Court's Order and Magnanimity
Later, the Bench passed a formal order noting that Pratap “instead of presenting the case, made incoherent and unparliamentary utterances.” However, displaying magnanimity, the Bench stated, “We have, however, considering the condition of the petitioner above named, do not propose to take any action against him.” The court dismissed his petition challenging an April 2026 Allahabad High Court verdict, finding no good ground to interfere with the impugned judgment.
Previous Incident of Misconduct
This incident follows a similar case on October 6, 2025, when an elderly advocate, Rakesh Kishore, attempted to hurl a shoe at then-Chief Justice BR Gavai during proceedings. Kishore was upset over Justice Gavai's alleged remarks on Hindu gods. Security escorted him out, and the Bar Council of India suspended his license, while the Supreme Court Bar Association terminated his membership. Justice Gavai also chose not to take action against Kishore.
