Ludhiana Court Hands Down 12-Year Sentences in Major Drug Injection Case

The case originated on February 11, 2019, when a police patrol from Sadar Khanna intercepted the two men near a shrine in Libra village. The convicted individuals, identified as Jaswinder Singh (29) and Moj Kumar (30), both residents of Kapurthala district, were observed carrying a single bag between them.
Upon conducting a search, police officers made a significant discovery:
- 98 injections containing Buprenorphine Hydrochloride
- 98 injections of Avil
The prosecution successfully argued that the men's attempt to hide behind the shrine upon seeing police officers demonstrated "conscious possession" of the prohibited substances.
Court Rejects Defense Arguments
During the trial proceedings, the defense team raised several objections:
- They argued that police failed to include independent civilian witnesses during the search and seizure
- They suggested the possibility that drugs were planted on the accused
However, the court firmly rejected these arguments, stating that "the evidence of official witnesses cannot be distrusted simply due to the non-examination of independent witnesses." The judge emphasized that such testimony remains valid when it withstands careful scrutiny.
The court further noted that the accused failed to provide any evidence of police ill-will or enmity that might justify claims of false implication. Additionally, the defendants made no effort to report their alleged false implication to higher authorities at the time of their arrest.
Legal Clarification on Substance Classification
While a total of 196 injections were recovered during the arrest, the court provided important legal clarification regarding their classification:
- The 98 injections of Avil do not fall under the Narcotic Drugs and Psychotropic Substances (NDPS) Act
- The conviction was specifically based on the 98 injections containing the prohibited salt Buprenorphine Hydrochloride
