Mother and Son Sentenced for Drug Peddling in Ludhiana
A special court in Punjab has delivered a stern verdict, sentencing a mother and son to rigorous imprisonment for their involvement in a localized drug peddling operation. The case, which unfolded in Ludhiana, involved the distribution of intoxicant powders, tablets, and the handling of illicit funds, highlighting ongoing efforts to combat narcotics in the region.
The Convictions and Sentences
Judge Radhika Puri of the Special Court imposed a two-year rigorous imprisonment term on Gagandeep Singh for the conscious possession of intoxicant powder and tablets. His mother, Nirmal Kaur, received a sentence of one year and four months. The convictions followed police recoveries of contraband and Rs. 49,000 in cash from their family home, underscoring the severity of their offenses.
The Dholewal Chowk Sting Operation
The legal proceedings stem from a July 2021 operation led by Inspector Amandeep Singh of Division Number Six police. Acting on a confidential tip-off that the duo were habitual drug dealers, authorities moved to intercept Gagandeep near Sherpur Chowk. Prosecution evidence revealed that upon spotting the police, Gagandeep attempted to discard a polythene bag and flee. Officers recovered pink intoxicant powder and 120 intoxicating tablets from the discarded bag.
A subsequent search of the family residence led to the apprehension of Nirmal Kaur. Police discovered additional intoxicants and a cache of drug money concealed within the frame of a bed, further implicating the pair in the illicit trade.
Court Proceedings and Defense Arguments
During the trial, the defense argued that the case was fabricated, pointing to a lack of independent civilian witnesses during the search and seizure. However, Judge Puri dismissed these claims, citing established legal principles. The court observed, The testimony of police officials cannot be discarded merely on the ground of non-association of independent witnesses, if their depositions are otherwise cogent and reliable.
The court found the evidence provided by official witnesses to be consistent and free from material contradictions, noting there was no evidence to suggest the family had been falsely implicated. This ruling reinforces the judiciary's reliance on credible police testimony in narcotics cases.
Sentences, Fines, and Technical Limitations
In addition to their prison terms, the court imposed a fine of ₹20,000 on each convict. Failure to pay the fine will result in an additional two months of rigorous imprisonment for both Gagandeep Singh and Nirmal Kaur. The court also noted a technical limitation regarding the total volume of drugs; because chemical analysis samples were not proven to be representative of the entire bulk due to varying batch numbers, sentencing was based on the specific quantities verified by the laboratory.
This case serves as a reminder of the legal complexities in drug-related prosecutions and the stringent penalties imposed on those involved in such activities. The sentences aim to deter similar offenses and uphold public safety in Punjab.
