Madras High Court Rejects Plea to Ban Events Near Madurai Toll Plaza
In a significant ruling, the Madras High Court on Monday dismissed a public interest litigation (PIL) that sought to prohibit political rallies, religious gatherings, and other events near the toll plaza on the Kappalur-Uthangudi Ring Road in Madurai district. The court, however, underscored that authorities must take all necessary measures to maintain hassle-free operations at toll plazas.
Petitioner's Concerns Over Traffic Congestion
The PIL was filed by A R Jeyarhuthran from Tirunelveli district, who highlighted severe traffic disruptions caused by various events conducted by political parties near the ring road. According to the petitioner, state and district-level conferences held in venues adjacent to the road have led to immense public hardship, with commuters facing inordinate delays. This congestion, the petitioner argued, defeats the purpose of collecting tolls, which is intended to ensure smooth and uninterrupted travel.
The petitioner specifically requested the court to direct authorities to:
- Ensure proper maintenance of the Kappalur-Uthangudi ring road.
- Prohibit political rallies, religious congregations, processions, cultural events, and the construction of marriage halls, community halls, commercial complexes, malls, or similar establishments near the toll plaza.
- Prevent arbitrary exemptions for political convoys or private individuals, except those explicitly allowed under law.
Court's Observations and Dismissal
A division bench comprising Chief Justice Sushrut Arvind Dharmadhikari and Justice N Sathish Kumar heard the case. The bench noted that the petitioner's affidavit contained only general allegations without pointing to any specific violations. The judges emphasized that the prayer in the petition lacked supporting pleadings, and as per Supreme Court guidelines, the court cannot exceed the scope of the pleadings and evidence presented.
"The petitioner has not pointed out any specific violation in the affidavit, barring a general allegation that political convoys and/or private individuals are being granted exemption. The prayer sought in the petition is not supported by pleadings," the bench observed.
Consequently, the court dismissed the petition. However, it made a clear directive that authorities should take all effective steps to ensure toll plazas remain hassle-free and that no exemptions are granted in violation of applicable laws.
