The Madurai Bench of the Madras High Court has directed the Tamil Nadu government to clarify its stance on the Thiruparankundram Deepam issue. The court's order came during the hearing of a public interest litigation (PIL) filed by a devotee seeking permission to conduct the traditional deepam (lamp-lighting) ceremony at the Thiruparankundram Murugan Temple.
Background of the Case
The PIL was filed by R. Subramanian, a resident of Thiruparankundram, who claimed that the temple authorities had stopped the annual deepam ceremony without any valid reason. The petitioner argued that the ceremony has been conducted for centuries and is an integral part of the temple's traditions. He further submitted that the denial of permission violates the religious rights of devotees.
Court's Observations
During the hearing, a division bench comprising Justice R. Suresh Kumar and Justice G. Arul Murugan observed that the state government must take a clear stand on the matter. The bench noted that the deepam ceremony is a religious practice protected under Article 25 of the Constitution, which guarantees freedom of conscience and free profession, practice, and propagation of religion.
The court also expressed concern over the lack of clarity from the Hindu Religious and Charitable Endowments (HR&CE) department regarding the issue. The bench directed the state government to file a counter-affidavit within four weeks, detailing its position on the conduct of the ceremony.
Government's Response Sought
The court has asked the Tamil Nadu government to explain why the deepam ceremony should not be allowed. The government must also clarify whether any alternative arrangements have been made to ensure the religious sentiments of devotees are respected. The matter has been adjourned for further hearing after six weeks.
