Mapusa Court Denies Bail to Accused in 2020 Siolim Double Murder Case

A Mapusa court in Goa has firmly rejected the bail application of Rovina Pereira Lobo, who stands accused in the chilling 2020 Siolim double murder case involving the deaths of her husband's two aunts. This marks the third time Lobo's plea for bail has been denied, underscoring the court's serious concerns about the case's gravity and the safety of witnesses.

Court Cites Child Witness Vulnerability and Offense Severity

In a detailed order, Additional Sessions Judge Dvijple V Patkar of the North Goa court in Mapusa emphasized that the release of the accused on bail could not be justified. The judge highlighted that the child witnesses—Lobo's own children—have provided testimony against their mother, making them particularly vulnerable to potential threats, intimidation, or even danger to their lives.

"Considering the gravity of the offence and severity of punishment and that the child witnesses have deposed against the accused no.1 mother, I am of the view that the accused no.1 cannot be released on bail merely on the ground that she has been in custody since Nov 2020 or on the health grounds disclosed by her," stated Judge Patkar.

Prosecution Arguments and Defense Pleas

During the proceedings, Public Prosecutor J Santamaria presented compelling arguments against granting bail. The prosecution revealed that a surprise inspection had uncovered a mobile phone in Lobo's possession while in custody. Furthermore, the complainant reported receiving threats from Lobo during the examination process, adding to concerns about witness tampering.

Santamaria also pointed out that several crucial witnesses, including neighbors, are yet to be examined, which could be jeopardized if bail were granted. The prosecution maintained that Lobo's medical issues could be adequately addressed within the jail facility, negating one of her primary grounds for release.

Lobo's Bail Application and Health Claims

In her third bail application, Rovina Lobo, who has been in custody since her arrest on November 16, 2020, pleaded for release on multiple grounds. She emphasized her status as a female inmate with ongoing health problems and argued that her children desperately need her care and presence.

Lobo contended that since the statements of her husband and children have already been recorded and completed, there exists no possibility of her threatening or tampering with evidence. However, the court found these arguments insufficient to outweigh the serious nature of the allegations.

Court's Final Ruling on Medical and Custody Grounds

The court delivered a firm verdict, stating that neither the duration of custody nor the disclosed health conditions warranted bail in this particular case. Judge Patkar explicitly noted that the medical grounds presented were not substantial enough to counterbalance the grave concerns surrounding the heinous offense—the alleged double murder of two elderly aunts.

"The medical grounds urged are not of such a nature as to outweigh these grave concerns, particularly in the context of a heinous offence involving the alleged double murder of elderly aunts. In such circumstances, no case for the grant of bail is made out," the court order concluded.

This ruling reinforces the judicial system's commitment to protecting witness integrity and ensuring that serious crimes are thoroughly investigated without compromise, even as the accused remains incarcerated pending further legal proceedings.
