Justice Chaubey elaborated, "None of the content can be said to be promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc. Rather, it is only showing a protest in favour of a foreign country." This observation highlighted the court's view that the actions of the accused were merely expressions of support for Iran, which is currently engaged in conflict with the USA, and did not constitute a criminal offense under Indian law.

Background of the Arrest and Bail Conditions

The case originated from an FIR lodged by Brajesh Chavariya on March 7, 2026, in Raisen. Chavariya alleged in his complaint that he encountered an Instagram reel featuring Wasim Khan and Yousuf Mehafooz, along with others, raising slogans in favor of Iran. Based on this complaint, the Raisen police arrested the two men the following day.

During the bail hearing, the judge reviewed the case diary and noted that the evidence primarily consisted of the Instagram reel. Justice Chaubey remarked, "The material placed in the case diary shows that the offence has been registered against the applicants only on the basis of a reel on Instagram in which the applicants along with others are expressing support for a foreign country Iran." This reinforced the court's conclusion that the charges were unfounded.

Consequently, the court ordered the release of Wasim Khan and Yousuf Mehafooz on bail. They were required to furnish a personal bond of Rs 50,000 and a surety of the same amount.
