Madhya Pradesh High Court Quashes FIR Against Revenue Official in Land Demarcation Case

The Jabalpur bench of the Madhya Pradesh High Court has delivered a significant ruling by quashing a First Information Report (FIR) filed against a revenue official, known as a patwari, in a contentious land demarcation case. The decision came in response to a plea submitted by the official, Rajnandini Mishra, who challenged a trial court order that had directed the registration of the FIR against her.

Background of the Case

The case, which was officially filed in the year 2025, has its origins in revenue proceedings dating back to 2018. These proceedings took place in Bheda village, located within the Sleemanabad area of Katni district. The core allegation revolved around the issuance of notices in the name of an individual who was already deceased, declaring him an encroacher on the land in question.

Following a complaint lodged by the legal heirs of the deceased person, the High Court had previously directed criminal action against all individuals involved in the matter. Consequently, the Sleemanabad police registered a case under multiple sections of the Indian Penal Code (IPC) against several persons, including the revenue official, Rajnandini Mishra.

Legal Proceedings and Defense

In an effort to clear her name, Mishra approached the trial court seeking the cancellation of the FIR. However, her plea was rejected, which prompted her to escalate the matter by challenging the FIR directly in the High Court. In her petition to the High Court, Mishra presented a compelling defense, asserting that she had no involvement whatsoever in the 2018 revenue proceedings.

She further claimed that she was not even in service at the time of the alleged irregularities. According to her submission, she was appointed as a patwari in 2021, on compassionate grounds following the death of her brother. This appointment occurred several years after the disputed events, strengthening her argument of non-involvement.

High Court's Ruling

The High Court, after reviewing the evidence and arguments, ruled in favor of Rajnandini Mishra. The bench stated that continuing criminal proceedings against her would constitute a misuse of the legal process. The court emphasized the importance of ensuring that legal actions are not pursued against individuals who are not connected to the alleged offenses, thereby upholding principles of justice and fairness.

This ruling not only provides relief to the revenue official but also sets a precedent for similar cases where individuals may be wrongfully implicated in legal matters due to procedural errors or misunderstandings.
