Nagpur Police Constable Files FIR Alleging Marital Rape by Estranged Husband
A 40-year-old woman police constable, currently posted at the Imambada police station in Nagpur, has lodged a serious criminal complaint against her 42-year-old estranged husband. The constable alleges that her husband drugged her and then forced her into unnatural sexual intercourse, in a case that brings the issue of marital rape into sharp focus.
Sequence of Events Leading to the Alleged Crime
According to the First Information Report (FIR) registered at the Nandanvan police station on April 20, the complainant had expressed a desire to meet her two sons on April 19. She contacted her husband around 9 AM, and he reportedly asked her to come to a location near the Nandanvan area, opposite a wine shop, at 4:30 PM, promising to bring the children along.
However, the husband arrived alone at the designated spot. He is alleged to have then taken her to a terrace, luring her under the pretext of having a chat and meeting their children later. The woman constable stated that her husband offered her a cold drink, which she later discovered was laced with powerful sedatives.
"After consuming the drink, I felt extremely dizzy and disoriented," the complainant stated in her police report. She alleges that around 8 PM, while she was in this vulnerable state, her husband forced her into unnatural intercourse without her consent. The constable emphasized that she was compelled into the act against her will, which led to her decision to file this latest case.
Legal Proceedings and Previous Complaints
This is not the first legal action the woman constable has taken against her husband. Earlier this year, she had registered another case against him and some relatives at the Imambada police station. Furthermore, she has already filed a divorce petition in the family court. Currently, she is residing with her mother for safety and support.
The Nandanvan police have registered the FIR based on the woman's detailed statement. The case invokes relevant provisions under the Bharatiya Nyaya Sanhita (BNS), including Section 67. This section specifically deals with sexual intercourse during separation without consent, which is punishable with imprisonment of not less than two years and may extend to seven years, along with a fine.
Investigation Status and Official Statements
As of now, the accused husband has not been arrested. The police are actively investigating the matter. A senior official commented on the case, stating, "This case underlines a sensitive intersection of family court proceedings and criminal complaints in estranged marriages. It highlights the complex legal and personal challenges faced by victims in such situations."
Authorities have confirmed that a medical examination of the victim has been conducted as part of the standard procedure. Additionally, an investigating team has visited the scene of the alleged incident near the Nandanvan area to gather further evidence and corroborate the complainant's account.
