Nashik Court Extends Custody of TCS Sexual Harassment Case Accused

A magisterial court in Nashik has ordered the custodial remand of two accused individuals until April 18, 2025. The accused are named in four out of nine total cases involving alleged sexual harassment and religious conversion attempts at the Tata Consultancy Services (TCS) office in Nashik.

Legal Proceedings and Custody Details

The two accused were previously lodged at Nashik Road Central Prison under magisterial custody after their police custody in two initial cases concluded. On Wednesday, the Special Investigation Team (SIT), which is probing all nine cases, secured their custody from jail through a production warrant related to a third case against them. They were produced before the court on Thursday, where the remand was granted.

The third case, for which they are now in police custody, involves offences under Sections 74 (assault or criminal force to a woman with intent to outrage her modesty), 75 (sexual harassment), 79 (word, gesture, or act intended to insult the modesty of a woman), and 3(5) (common intention) of the Bharatiya Nyaya Sanhita (BNS).

Prosecution's Arguments for Extended Custody

Assistant Public Prosecutor (APP) Aniket Avhad argued for a seven-day custody extension, emphasizing the serious nature of the offences. "We sought custody on grounds that this is a serious workplace offence involving molestation and sexual harassment, and the investigation is still in its primary stages," Avhad stated.

The prosecution highlighted that since the crimes occurred within the TCS office premises, there is a possibility that other female employees might have additional complaints against the accused. Furthermore, the cellphone of one suspect remains to be seized for technical analysis, which is crucial for the ongoing investigation.

Clarification on TCS Office Operations

Amid reports on Thursday morning suggesting that the TCS Nashik office had shut down due to the scandal, Deputy Labour Commissioner Vikas Mali provided clarification. "We visited the company and met with an HR official who informed us that staff are currently working from home due to the ongoing situation. There are no reports indicating permanent closure of the unit," Mali explained.

This statement aims to dispel rumors and confirm that TCS operations in Nashik continue, albeit with adjustments in response to the investigation.

The case has drawn significant attention due to its workplace context and the involvement of a major corporate entity like TCS. The SIT's investigation into all nine cases is ongoing, with authorities focusing on gathering evidence and testimonies to build a comprehensive case.
