Hyderabad Mall Management Faces Negligence Charges After Staff Member's Tragic Death
In a distressing incident that has raised serious questions about workplace safety protocols, the Punjagutta police in Hyderabad have officially registered a negligence case against the management of a prominent mall located in the Errum Manzil area. This legal action follows the untimely death of a 49-year-old housekeeping staff member, identified as Satyanarayana from Jummerat Bazar, who suffered a fatal heart attack during his night shift on Thursday.
Details of the Tragic Incident
According to Punjagutta Assistant Commissioner of Police P Murali Krishna, the housekeeping team at the mall typically performs cleaning duties during the nighttime hours. In the early morning of Thursday, at approximately 4 AM, Satyanarayana began experiencing severe chest pain and a general sense of uneasiness, which he promptly reported to his co-workers.
"Satyanarayana stepped outside the mall premises to drink some water," explained ACP Krishna. "He immediately contacted his family members, informing them that he was not feeling well. His relatives arrived swiftly at the location and transported him to Osmania General Hospital using a two-wheeler. Tragically, medical professionals at the hospital declared him dead upon arrival."
Family Protest and Allegations of Negligence
At around 9 AM, Satyanarayana's grieving family members brought his body back to the mall and initiated a protest, voicing strong allegations against the mall management. They claimed that his death was a direct result of gross negligence, as the management failed to provide immediate medical assistance or arrange for urgent hospital transportation after he complained of chest pain.
Police officials quickly responded to the scene, engaging with the family to de-escalate the situation. By approximately 2 PM, after assuring the family that a thorough investigation would be conducted, authorities successfully convinced them to allow the body to be shifted to Osmania General Hospital for a postmortem examination.
Legal Action Under the Bharatiya Nyaya Sanhita
"We have registered a formal negligence case against the mall management under Section 106(1) of the Bharatiya Nyaya Sanhita (BNS)," confirmed ACP P Murali Krishna. "A preliminary probe will be conducted alongside the postmortem report to determine the exact circumstances and establish whether there was any lapse in duty of care by the employer."
This case highlights critical issues regarding employee welfare and emergency response mechanisms in commercial establishments. The investigation will scrutinize the mall's protocols for handling medical emergencies, particularly for night-shift workers, and assess if adequate measures were in place to prevent such a tragedy.
