Odisha Government Plans Strict Legislation to Tackle Abusive Social Media Content
In a significant move to address the growing misuse of digital platforms, Odisha's Law Minister Prithiviraj Harichandan announced on Wednesday that the state government is planning to introduce stringent legislation targeting abusive posts on social media. The minister warned that such content may soon invite serious legal consequences as authorities seek to curb the proliferation of offensive and defamatory material online.
State Law Commission Recommendations Prompt Action
The minister's statement follows recommendations from the State Law Commission, which on Tuesday proposed a comprehensive set of measures aimed at regulating and discouraging the use of abusive language in digital spaces. Among the key proposals is a new legislation titled the Prevention of Hate Speech and Hate Crime Act, specifically designed to address offensive content on social media platforms and impose restrictions on hate speech.
"There are increasing instances of offensive and defamatory content on social media platforms and the government has taken serious note of it," Harichandan stated while addressing media persons in Bhubaneswar. "People across age groups are knowingly or unknowingly consuming such content, creating a toxic digital environment that requires immediate intervention."
Current Legal Framework Deemed Insufficient
Currently, Odisha relies on the Information Technology Act and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, to address unlawful and harmful online content and ensure accountability of intermediaries including social media platforms. However, authorities believe these measures are inadequate for the current challenges.
"Despite existing legal frameworks, social media platforms are becoming increasingly abusive and toxic," Harichandan explained. "Since the punishment is not stringent, those making abusive posts often manage to evade the legal net easily. The proposed legislation is aimed at addressing this gap and creating stronger deterrents against digital misconduct."
Defining Boundaries of Free Expression
Justice Biswanath Rath, chairman of the State Law Commission, emphasized that freedom of expression has limits when it comes to harmful content. "Freedom of expression does not extend to derogatory or abusive language that harms individuals or disrupts social order," he stated, adding that "the proposed law will cover not only social media platforms but also public spaces where instances of hate speech have become common."
The minister also stressed the importance of responsible digital behavior, urging citizens to exercise restraint and verify information before sharing it online. "Social media is a powerful tool but it must be used responsibly. Misuse can have serious legal consequences that individuals should be aware of," Harichandan cautioned.
Recent Incidents Highlight Urgent Need for Regulation
The push for stronger legislation comes against a backdrop of concerning incidents linked to social media misuse in Odisha:
- In October 2023, a man in Sambalpur was arrested for allegedly posting videos containing obscene and abusive language against women on a social networking site. Police reported that the content in his social media account was sexually explicit and offensive with potential to corrupt the minds of children.
- In September 2024, the state government had to impose an internet shutdown in Bhadrak town following violent communal clashes linked to inflammatory social media posts. Members of a particular community had protested derogatory remarks about their religious leader circulating online, leading to public disturbances.
These incidents underscore the real-world consequences of unchecked digital content and reinforce the government's determination to create a safer online environment through comprehensive legal measures.
