Patna High Court Overturns Convictions in 2015 Ara Civil Court Bomb Blast Case

In a significant legal development, the Patna High Court on Thursday acquitted Lambu Sharma, who had previously been sentenced to death in connection with a devastating bomb blast that occurred on the premises of the Ara civil court on January 23, 2015. The explosion resulted in the tragic death of a constable on duty and caused severe injuries to more than a dozen individuals, including police personnel and lawyers.

Acquittal of Six Other Convicts

A division bench, comprising Chief Justice Sangam Kumar Sahoo and Justice Rajeev Ranjan Prasad, also acquitted six other convicts in the same case. These individuals—Shyam Vinay Sharma, Rinku Yadav, Md Naim Miyan, Md Chand Miya, Anshul Kumar, and Akhilesh Upadhyaya, also known as Musa—had been awarded rigorous imprisonment for life for their alleged roles in the bomb blast.

Background of the Case

On August 17, 2019, a trial court presided over by the 3rd additional sessions judge in Bhojpur found Lambu Sharma and seven others guilty in the bomb blast case. Subsequently, on August 20, 2019, Lambu was sentenced to capital punishment, while the remaining seven convicts received life imprisonment. Notably, one of the convicts, Pramod Singh, passed away in prison during the Covid-19 pandemic.

Court's Appreciation for Amicus Curiae

In their comprehensive 174-page judgment, the two judges commended the efforts of advocate Prateek Mishra, who served as amicus curiae, or friend of the court, and provided crucial assistance to the high court by arguing in defense of the convicts. The court highlighted this case as a precedent in defining the role of an amicus curiae, emphasizing that such individuals can interact directly with convicts to better understand their cases and ensure fair representation.

This ruling marks a pivotal moment in the judicial process, underscoring the importance of thorough legal review and the potential for reevaluation in complex criminal cases.
