Pune Court Hands Down 10-Year Sentence for Attempted Rape of Minor
A sessions court in Vadgaon Maval, Pune district, has delivered a significant verdict, convicting and sentencing a 23-year-old painting worker to 10 years of rigorous imprisonment. The conviction stems from an incident on November 16, 2023, where the accused attempted to rape a 13-year-old girl on the terrace of a building located on Dehu Road.

Initially, the police had invoked the stringent charge under section 376(3) of the amended Indian Penal Code, which carries a maximum penalty of 20 years imprisonment for rape offences. However, after a thorough review of the case, additional sessions judge DK Anbhule made a critical observation.
The judge meticulously examined the depositions from witnesses, medical reports, and investigation documents on record. It was noted that the evidence did not substantiate the allegation of completed rape. Specifically, the survivor and her mother's statements, along with the forensic chemical analysis report and medical findings, failed to support the claim of forceful sexual intercourse.
"Nowhere is it stated that the assailant committed forceful sexual intercourse with the victim against her will," the judge remarked, referencing the testimonies that described the accused forcefully taking the girl to the terrace and attempting to abuse her physically.
Court's Decision and Conviction
Consequently, the court upheld the theory of attempted rape, convicting the accused under section 511 read with section 376(3) of the IPC, which pertains to attempts to commit rape. According to the additional public prosecutor, the incident occurred when the girl was fetching water. The accused, who resided in the neighbourhood, forcefully sexually assaulted her. She managed to escape and promptly alerted her parents, leading to his identification and subsequent handover to the police.
The court affirmed that while the prosecution successfully proved the assault, the available evidence, including the forensic and medical reports, did not corroborate the rape allegation. The accused has been in custody since November 17, 2023, and the court provided a set-off for the period he has already served.
