Failed Rajasthan SI Candidates File Supreme Court Caveat After Recruitment Cancellation

In a significant legal move, two candidates who were unsuccessful in the 2021 Rajasthan Sub-Inspector recruitment examination have proactively filed a caveat in the Supreme Court of India. The candidates, identified as Kailash Chandra Sharma and Pramod Kumar, aim to secure their right to be heard in case the state government or any of the selected candidates decide to challenge the recent Rajasthan High Court verdict that cancelled the entire recruitment process.

High Court Upholds Cancellation Over Irregularities

This legal action follows the pivotal ruling on April 4 by a division bench of the Rajasthan High Court, which firmly upheld the scrapping of the 2021 SI recruitment. The bench, comprising Acting Chief Justice S P Sharma and Justice Sangeeta Sharma, affirmed an earlier single-bench decision that had cancelled the entire selection process. The cancellation was ordered due to serious allegations of paper leaks, widespread malpractice, and numerous irregularities that compromised the examination's integrity.

The division bench dismissed appeals filed by the Rajasthan government and some of the selected candidates, while upholding the judgment delivered by Justice Sameer Jain on August 28, 2025. In its observation, the bench emphasized that when the sanctity, transparency, and fairness of an examination are fundamentally compromised, the cancellation of the entire recruitment process is not only justified but necessary to uphold justice and public trust.

Motivation Behind the Caveat Filing

Sharma and Kumar, the petitioners, expressed their concerns that the successful candidates or the state government might now approach the apex court to contest the high court's ruling. By filing the caveat, they seek to protect their legal interests and ensure that their perspectives are considered in any future Supreme Court proceedings. This step highlights the ongoing legal battles and the determination of affected parties to seek redress in a case that has significant implications for public service recruitment in Rajasthan.

Background of the Recruitment Process

The recruitment process for the Rajasthan Sub-Inspector positions began on February 3, 2021, when the Rajasthan Public Service Commission (RPSC) advertised a total of 859 posts for Sub-Inspector and Platoon Commander roles. These positions fall under the Rajasthan Police Subordinate Service Rules, 1989, and attracted a large number of applicants seeking careers in law enforcement. However, the process has been marred by controversies from the outset, leading to the high court's intervention and subsequent cancellation.

The case underscores the critical importance of maintaining integrity in competitive examinations, especially for government positions that demand public trust. As the legal proceedings continue, all eyes are on the Supreme Court for any further developments that could shape the future of this recruitment and set precedents for handling similar cases of examination malpractice in India.
