Senior advocate Abhishek Manu Singhvi, representing Khera, argued that his client was prepared to approach the Assam court but requested a five-day protection window, citing that the petition could only be filed on Monday. However, the bench dismissed this request, stating that Khera could file the petition on Friday or Saturday and seek an urgent hearing, even if the concerned court was not in session.

In its order, the Supreme Court bench provided clear directives to ensure fairness in the upcoming bail proceedings. It stated, "...We again make it clear that upon filing an application seeking anticipatory bail by Respondent No. 1 (Khera), the court deciding such bail application shall not be adversely influenced by any observations made in the order of this Court dated April 15 staying the transit bail..." This clarification aims to prevent any prejudicial impact from the Supreme Court's prior decisions on the Assam court's evaluation of Khera's bail plea.
