SC Rejects Plea on Ballot Papers in Punjab Local Polls

The Supreme Court on Friday refused to entertain a plea challenging the use of ballot papers in the upcoming local body elections in Punjab. A bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia observed that the petitioner had alternative remedies available and declined to interfere with the election process.

Petition Dismissed

The petition, filed by one Gurpreet Singh, sought a direction to the State Election Commission to use electronic voting machines (EVMs) instead of ballot papers for the municipal corporation and panchayat elections. The petitioner argued that the use of ballot papers could lead to malpractices and was a regressive step.

Court's Observation

The bench, however, noted that the election process was already underway and that the petitioner could approach the appropriate forum under the Punjab State Election Commission Act. "We are not inclined to entertain this petition under Article 32. The petitioner has alternative remedies," the court said.

The court further clarified that it was not expressing any opinion on the merits of the case, leaving it open for the petitioner to seek legal recourse before the relevant authority.

Background

The Punjab government had earlier decided to conduct local body polls using ballot papers, citing logistical challenges and cost factors associated with EVMs. This decision was challenged by various political parties and civil society groups, who argued that EVMs ensure transparency and reduce the chances of fraud.

The State Election Commission had defended the use of ballot papers, stating that it was a temporary measure and that EVMs would be used in future elections. The commission also assured that adequate security measures would be in place to ensure free and fair polls.

The Supreme Court's refusal to entertain the plea means that the local body elections in Punjab will proceed with ballot papers as planned. The elections are scheduled to be held in two phases later this month.
