Supreme Court Issues Contempt Warning Over Litigant's Alleged Contact with CJI's Brother

The Supreme Court of India has taken a firm stance against what it deems as serious misconduct, warning of potential criminal contempt proceedings. This action follows allegations that a litigant's father contacted the brother of Chief Justice of India Surya Kant to object to a court order.

Court's Stern Reaction During Hearing

During a hearing on Wednesday, Chief Justice Surya Kant expressed visible upset over the incident. He questioned the petitioner's counsel, asking, "You tell us why we should not initiate criminal contempt… Should I disclose it in open court?" The CJI elaborated, stating, "He calls up my brother and asks him how the Chief Justice of India has passed this order… Will he dictate us? This is his conduct." He emphasized the gravity of the situation, adding, "Nobody dares to do this… And you think I will transfer the case because of this?"

The counsel for the petitioner expressed ignorance and offered an apology, but the Bench remained stern. The CJI advised, "You verify it. As counsel, you should first consider withdrawing. This is sheer misconduct," and noted, "Even if he is outside India, I know how to deal with such people." The court also remarked, "I think you are trying to manipulate matters there as well."

Background of the Fraudulent Admission Case

The matter pertains to a petition filed by Nikhil Kumar Punia and another individual, who sought admission to a postgraduate medical course under the Buddhist minority quota at a minority-run institution in Meerut. Earlier, on January 28, the Supreme Court had dismissed the petition, terming it a "new type of fraud." The Bench observed that the candidates had initially applied as general category in NEET-PG 2025 and later sought minority status, leading to the remark, "Wow! This is a new type of fraud."

Court Directives and Ongoing Examination

The Supreme Court has now directed the Haryana Government to file compliance with its earlier order. The Bench warned, "If not, the Chief Secretary of the State of Haryana shall remain personally present in Court on the next date." Additionally, the apex court is examining the procedure for issuing minority certificates in Haryana. It has raised critical questions, including:

  • What are the guidelines for issuing a minority certificate?
  • Is it permissible for a general category candidate to subsequently declare themselves as belonging to the Buddhist minority?

The Bench has also sought clarification on the basis upon which the Sub-Divisional Officer issued such certificates. The hearing has been deferred to next week, with the court maintaining a vigilant stance on both the procedural issues and the alleged misconduct by the litigant.
