Telegram, the popular messaging platform, has moved the Delhi High Court against the Indian government's decision to ban the app for its alleged role in the NEET-UG retest paper leak. The company filed a petition on Wednesday, seeking to overturn the ban imposed by the Ministry of Electronics and Information Technology (MeitY).
Background of the Ban
The government had ordered internet service providers to block Telegram on June 15, accusing the platform of being used to share leaked question papers for the NEET-UG retest scheduled for September. The ban came amid a massive crackdown on alleged irregularities in the medical entrance exam.
Telegram's Legal Challenge
In its petition, Telegram argued that the ban was disproportionate and violated the principles of natural justice. The company stated that it had not received any prior notice or opportunity to respond before the block was implemented. It further contended that the platform merely facilitates communication and cannot be held responsible for user-generated content.
Telegram also highlighted its cooperation with law enforcement agencies in the past, including the removal of channels involved in illegal activities. The company urged the court to stay the ban, citing the impact on millions of legitimate users in India.
Government's Stance
The government, represented by the Additional Solicitor General, defended the ban, stating that it was necessary to prevent further leakage of exam papers and maintain the integrity of the examination process. The authorities claimed that Telegram was the primary platform used by the conspirators to distribute the leaked paper.
The court is expected to hear the matter next week, with both sides presenting their arguments. Meanwhile, Telegram remains blocked in India, affecting over 200 million users.
Wider Implications
The case has sparked a debate on freedom of speech and the extent of government's power to ban digital platforms. Legal experts suggest that the outcome could set a precedent for future regulatory actions against messaging apps in India.
