Vadodara Tribunal Awards Rs 55.42 Lakh Compensation After Eight-Year Legal Battle

In a significant ruling, the Vadodara Motor Accidents Claim Tribunal (MACT) has directed a compensation payment of Rs 55.42 lakh to the family of a 33-year-old school principal who tragically lost his life in a highway crash nearly eight years ago. The fatal accident occurred in September 2016 in the Limbdi taluka of Surendranagar district, Gujarat.

Details of the Tragic Highway Collision

The incident involved Vipul Patel, a resident of Padra taluka in Vadodara, who was driving on the highway with his friend Ketan Patel as a passenger. Their car collided with a stationary truck parked on the roadside. According to tribunal evidence, the truck driver, Deva Rabari, had parked the vehicle but failed to switch on its parking lights, creating a hazardous condition on the dark highway.

The impact was severe, with Vipul Patel sustaining injuries that proved fatal. Ketan Patel also suffered serious injuries in the collision. At the time of his death, Vipul was serving as the principal of a primary school in Padra, leaving behind a grieving family and community.

Legal Proceedings and Tribunal Findings

Following the accident, Vipul's wife Apexa Patel and other family members filed a compensation claim of Rs 70 lakh against multiple parties:

  • Truck driver Deva Rabari
  • Truck owner Arvind Jadeja
  • Their insurer, HDFC Ergo General Insurance Company Ltd.

Ketan Patel separately filed a claim for the injuries he sustained during the accident.

The defense argued that the truck had been parked within the compound of an eatery and that the driver had gone for refreshments, suggesting there was no requirement to keep parking lights illuminated. However, after thorough examination of all evidence, the tribunal concluded that the truck driver bore primary responsibility for the accident due to the dangerous parking conditions created.

Compensation Award and Financial Implications

The tribunal's final order includes:

  1. Rs 55.42 lakh compensation to Vipul Patel's family, to be paid jointly by the truck owner and insurance company with 9% annual interest
  2. Rs 1.75 lakh compensation to Ketan Patel for injuries sustained

This ruling comes after extensive legal proceedings that spanned nearly eight years, highlighting the often lengthy process families must endure when seeking justice through motor accident claim tribunals. The compensation amount reflects both the financial loss to the family and the circumstances of the accident where proper safety measures were not followed.

The case serves as an important reminder about road safety responsibilities, particularly regarding proper illumination of stationary vehicles on highways during nighttime conditions. It also demonstrates the legal recourse available to accident victims and their families through India's motor accident claim system.
