A special POCSO court in Etah has delivered a significant verdict, convicting a 43-year-old woman for falsely accusing her husband of raping their 16-year-old daughter, leading to his imprisonment in 2019. The case originated on September 4, 2019, when the woman filed a police complaint against her husband, then aged 40, alleging he had raped their daughter. Following this, an FIR was registered under IPC section 376 (rape) and provisions of the Protection of Children from Sexual Offences (POCSO) Act, resulting in the husband's arrest.

Despite the accused husband filing a bail plea claiming the case was a fabricated political conspiracy, his application was rejected due to the serious nature of the charges. He remained in jail for nearly 18 months before the truth emerged.

Investigation Reveals False Accusation Stemming from Family Dispute

After a chargesheet was filed in October 2019, the trial investigation uncovered that the woman had leveled the allegations due to a family dispute, particularly disagreements over arranging their minor daughter's marriage. This revelation led to the husband's acquittal in January of this year, after which separate proceedings were initiated against the woman under Section 22 of the POCSO Act, which addresses punishment for false complaints.

Court's Strong Condemnation and Sentencing

In its ruling on Thursday, the court described the woman's actions as highly condemnable, stating she misused the law for personal vendetta and used her daughter as a pawn. The judgment stressed that illiteracy cannot be cited as a defence in such serious offences, underscoring the importance of accountability in legal matters.

In addition to the 30-day jail term, the court imposed a penalty of Rs 500. Non-payment of this fine will result in an additional seven days of imprisonment, as confirmed by Additional District Government Counsel Shri Krishna Yadav.
