The Election Commission of India has officially clarified that a letter bearing the seal of the Bharatiya Janata Party (BJP) was circulated due to a clerical error. This response comes after the Communist Party of India (Marxist) in Kerala shared images of the document, alleging improper conduct.

CPI(M) Accusations and Social Media Post

The CPI(M) Kerala unit posted on social media platform X, displaying the letter dated March 19, 2019, which featured the BJP seal. The party questioned whether all pretences had been dropped, suggesting that the same power centre controls both the Election Commission and the BJP. In a snarky remark, they stated, "Even then, at least maintain the courtesy of two separate desks. Now, even that seems unnecessary."

Further comparing the incident to older allegations of Electronic Voting Machine (EVM) tampering, the CPI(M) remarked, "Seals are being casually swapped. A BJP seal on an Election Commission letter! Just like the old allegation - that no matter which button you press, the lotus appears - here comes another 'coincidence.' Shouldn’t someone be paying attention?" The party claimed the document was received by multiple parties and cross-verified with at least two recipients, confirming it originated from an official EC source.

Election Commission's Detailed Clarification

In response, the Election Commission issued an official statement acknowledging the fault. The Office of the Chief Electoral Officer (CEO) in Kerala explained that the BJP Kerala Unit had approached them seeking clarification on the 2019 guidelines regarding the publication of criminal antecedents of candidates. Along with their request, the BJP submitted a photocopy of the original 2019 directive, which bore the party's seal.

Due to an oversight, the office failed to notice the party symbol on the submitted document and inadvertently redistributed it to other political parties as part of the requested clarification. The EC emphasized that the guidelines have since been revised and communicated to all political entities.

Immediate Rectification Measures

The Election Commission stated that the lapse was identified promptly. On March 21, the Deputy Chief Electoral Officer issued a formal letter withdrawing the erroneous document. This withdrawal notice was dispatched to all political parties, District Election Officers, and Returning Officers to prevent any further confusion.

The EC urged the public and media to refrain from spreading misleading messages based on this clerical error. "The Election Commission maintains a rigorous and foolproof system to ensure that the electoral process remains free from any external interference or influence," the statement asserted, reinforcing the commission's commitment to impartiality.

This incident occurs as Kerala prepares for polling in a single phase on April 9, with vote counting scheduled for May 4. The clarification aims to maintain transparency and trust in the electoral process amidst political tensions.
