Cabinet Approves Amendment to Transgender Rights Act for More Inclusive Definition

The Union Cabinet on Tuesday gave its approval to a proposal aimed at amending the Transgender Persons (Protection of Rights) Act, 2019. This move seeks to broaden the definition of transgender persons in an effort to make the legislation more inclusive, ensuring that all bona fide individuals receive the intended benefits and protections under the law.

Addressing Implementation Concerns

There has been ongoing debate regarding the implementation of the Act, with community leaders periodically raising concerns. Even the Supreme Court has expressed worry over the slow and inconsistent enforcement of the law. While official details of the proposed changes were not disclosed on Tuesday, sources indicate that the amendment bill aims to provide greater clarity in defining transgender persons compared to the existing provisions.

Officials have stated that the bill proposes to elaborate more thoroughly on the criteria for identifying transgender individuals, thereby ensuring there is no misuse of the provisions. This step is seen as crucial for enhancing the effectiveness and reach of the Act.

Background of the Transgender Persons Act

The Transgender Persons (Protection of Rights) Act, 2019, which came into effect on January 10, 2020, establishes provisions for legal recognition, prohibits discrimination, and mandates welfare measures for transgender individuals. The rules to implement this law were notified on September 25, 2020.

Section 2 of the Act deals with definitions and specifies that a "transgender person" includes trans-men and trans-women, intersex persons, gender queer individuals, hijra, and others, irrespective of whether they have undergone surgery. Specifically, it states: "A 'transgender person' means a person whose gender does not match with the gender assigned at birth and includes trans-man or trans-woman (whether or not such person has undergone sex reassignment surgery or hormone therapy), person with intersex variations, genderqueer and persons having such socio-cultural identities as kinner, hijra, aravani and jogta."

Implications of the Amendment

The proposed amendments are expected to refine this definition further, making it more comprehensive and inclusive. By spelling out the identification criteria in greater detail, the government aims to prevent any potential misuse of the Act's provisions while ensuring that all eligible persons can access the protections and benefits intended for them.

This development marks a significant step towards strengthening the legal framework for transgender rights in India, addressing long-standing concerns from the community and judicial bodies alike.
