India Revises Foreigner Registration Rules, Tightens Stay Extension

The Ministry of Home Affairs (MHA) has amended the Immigration and Foreigners Rules, introducing significant changes to foreigner registration requirements in India. Under the revised provisions, foreign nationals seeking to stay beyond 180 days must now register before the expiry of the 180-day period, replacing the earlier rule that allowed registration within 14 days after crossing the threshold.

Key Changes in Registration Process

The new rule mandates that foreign visitors who intend to remain in India for more than 180 days must complete their registration with the Foreigners Regional Registration Officer (FRRO) before the 180-day period ends. Previously, they had a 14-day grace period after exceeding 180 days. This change aims to ensure stricter compliance and prevent overstays.

Relief for Children Born in India

The notification also provides limited relief for children born in India where one or both parents are foreign nationals. The reporting requirement after birth will no longer apply if either parent is an Indian citizen and wishes the child to retain Indian citizenship. However, authorities must be informed within 30 days if the child later acquires foreign citizenship. This provision clarifies the status of children born to mixed-nationality couples and reduces bureaucratic hurdles.

Updated Obligations for Medical Institutions

Additionally, the MHA has updated reporting and administrative obligations for hospitals, nursing homes, and medical institutions offering accommodation facilities. These entities must now maintain detailed records of foreign patients and report their stay to the FRRO within a specified timeframe. The move is expected to enhance monitoring of foreign nationals receiving medical treatment in India.

Broader Push for Digitalisation and Compliance

The changes come amid a broader push by the Centre to streamline immigration and citizenship procedures through digitalisation and stricter compliance measures. The MHA has been working on integrating various databases and online portals to facilitate easier registration and tracking of foreign nationals. The revised rules are part of ongoing efforts to balance openness to foreign visitors with national security concerns.

Foreign nationals and institutions affected by these changes are advised to familiarise themselves with the new requirements to avoid penalties. The MHA has stated that further guidelines will be issued to ensure smooth implementation.
