A special court in Bengaluru on Friday delivered a setback to Bharatiya Janata Party (BJP) legislator BA Basavaraj, refusing to grant him interim bail in connection with a murder investigation. The court has adjourned the hearing on his anticipatory bail petition to Monday, prolonging the legal uncertainty for the MLA from KR Pura constituency.
Legal Setback After High Court's KCOCA Ruling
The development comes a day after the Karnataka High Court provided a partial relief to the lawmaker. On Friday, the high court quashed a government order that had permitted the Criminal Investigation Department (CID) to invoke the stringent Karnataka Control of Organised Crime Act (KCOCA) against Basavaraj and other accused. However, the bench did not grant him anticipatory bail, leaving the door open for his arrest under other legal provisions.
Following the high court's decision, Basavaraj's legal team promptly approached the special court seeking anticipatory bail. The special court, however, decided to postpone the matter. It issued a formal notice to the CID, directing the investigative agency to file its objections to the bail plea. It was after this adjournment that the defense counsel made a plea for interim bail until Monday, a request the court firmly denied.
CID's Pursuit and the Accused List
Parallel to the court proceedings, the CID is actively pursuing its investigation. Agency sources have indicated that they are attempting to contact Basavaraj to record his official statement regarding the case. A senior Indian Police Service (IPS) officer involved in the probe stated that the lawmaker has become "incommunicado," raising questions about his availability to the investigating officers.
The case revolves around the murder of a 40-year-old man identified as Shivakumar, also known as Biklu Shiva. The crime took place on July 15 in Bengaluru's Bharathinagar area. The police have cast a wide net in this case, naming a total of 18 individuals as accused. Basavaraj is listed as accused number five in the First Information Report (FIR). So far, the CID has succeeded in arresting 17 of the 18 accused, leaving the MLA as the sole person from the list not yet in custody.

The legal focus now shifts to Monday's hearing in the special court. The CID's submitted objections will play a crucial role in the court's final decision on the anticipatory bail petition. The denial of interim bail indicates the court's current stance on the immediacy of the request.
