A special court in Mumbai has issued a significant directive to the Anti-Corruption Bureau (ACB), ordering the registration of a First Information Report (FIR) against Shiv Sena's Kurla legislator, Mangesh Kudalkar. The order, passed on Wednesday, December 17, 2025, stems from serious allegations of misusing public funds sanctioned for development projects in his constituency.
Serious Allegations of Fund Diversion
The court's intervention came after hearing an application filed by a complainant, Ramesh Satyan Borwa. Borwa alleged that MLA Kudalkar diverted funds meant for public welfare to construct a hall and commercial centres on a plot reserved by the Maharashtra Housing and Area Development Authority (MHADA). The plot was originally designated for amenity services and a garden.
According to the complaint, instead of executing the sanctioned development works for the public, Kudalkar allegedly used the money for these unauthorised constructions. The complainant further claimed that these illegally built structures are now being given out on rent for personal gain, constituting a clear case of misconduct by a public servant.
Court Cites 'Serious' Nature, MHADA Letter as Evidence
Special Judge Satyanarayan R Navander, who presides over matters related to MPs and MLAs, noted the gravity of the accusations. The judge observed that the allegations were "serious in nature" and warranted a thorough investigation. A crucial piece of evidence influencing the court's decision was a letter dated November 25, 2025, issued by MHADA to the complainant.
Borwa, who appeared in person before the court, stated that this official communication from the housing authority confirmed his allegations regarding the misuse. The court's order records, "Prima facie, it appears that on the plot reserved by MHADA for amenity service and garden, a hall is constructed with some commercial centres unauthorisedly... The allegations are specific."
Legal Proceedings and Investigation Ordered
Acting on Borwa's plea, the court invoked the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. The judge directed the Senior Police Inspector of Nehru Nagar Police Station to register the FIR and conduct a comprehensive probe under Section 175(3) of the BNSS. The complaint has been forwarded to the Assistant Commissioner of Police (ACP) of the ACB in Mumbai for further action.
The court has mandated that the police submit a final report within the prescribed period. The proposed FIR would include charges under Sections 7 (public servant obtaining undue advantage) and 13(2) (criminal misconduct by public servant) of the Prevention of Corruption Act, among other legal provisions.
When approached for comment by the media, MLA Mangesh Kudalkar stated that he was unaware of the court's order and would respond only after receiving an official notice or communication regarding the matter. The ACB is now legally bound to initiate a formal investigation into these corruption allegations, marking a critical step in the legal process.
