Maharashtra CM Fadnavis Announces Major Reforms to Expedite Rental Housing Dispute Resolution
In a significant move aimed at accelerating the resolution of rental housing disputes, Maharashtra Chief Minister Devendra Fadnavis issued a series of directives on Friday. The announcements came during a high-level review meeting of the state government's rental housing policy held at the Sahyadri State Guest House in Mumbai.
Appointment of DCP as Competent Authority and Establishment of Special Courts
Fadnavis directed the immediate appointment of a Deputy Commissioner of Police (DCP) as the competent authority under the Maharashtra Rent Control Act of 1999. He emphasized the need for swift notification to implement this measure effectively. Additionally, the Chief Minister ordered the establishment of 100 special courts dedicated exclusively to the speedy resolution of rent-related complaints.
To ensure these courts operate efficiently, Fadnavis proposed the appointment of retired judges to preside over them. He also instructed the Law and Judiciary Department to seek necessary permissions from the court to set up evening courts specifically for disposing of pending rental cases. "If space is not available for these courts, space should be taken on rent," Fadnavis stated, highlighting the urgency of the initiative.
Development of Online Portal for Affordable Rental Housing
Recognizing the massive demand for housing in Mumbai, particularly from individuals migrating for employment or business opportunities, Fadnavis directed the State Housing Department to develop a comprehensive online portal. This portal is designed to assist citizens in finding affordable rental housing options conveniently.
"Since there is a massive need for housing, a competent mechanism should be established and operationalised for affordable rental housing," Fadnavis remarked during the meeting. He further instructed officials to align rental housing availability with the principle of supply according to demand, ensuring a balanced and responsive system.
Systematic Expansion and Confidence in Case Disposal
Fadnavis also mandated the implementation of a scalable system where the number of competent officers would automatically increase in tandem with the expansion of police station jurisdictions. This proactive approach aims to prevent bottlenecks and maintain efficiency as urban areas grow.
Expressing strong confidence in these reforms, Fadnavis asserted that they would significantly aid in disposing of rental cases that have been pending for years, thereby providing much-needed relief to both tenants and landlords.
